OnlineJoin McCarthy Tétrault’s National Appellate Litigation Group as we discuss appeals of importance to the Canadian business community during the last quarter. Each session brings you up-to-date on recent appellate developments across Canada. Topics to be discussed this quarter include:
- Supreme Court of Canada: The nullification of coverage doctrine in insurance contracts.
- Federal: “Text as anchor” in statutory interpretation: stabilizing force or a source of fresh debate?
- Ontario: Does a party waive solicitor client privilege by advancing pleadings or litigation conduct that puts its understanding of its legal rights or obligations in issue, even without expressly relying on legal advice?
- Québec: At the authorization stage, is it enough that the alleged facts support one arguable legal basis, such that the court should not analyze or dismiss the others absent exceptional circumstances?
- West: Provincial privacy laws limit global tech company’s AI-driven collection of internet data.
