McCarthy Tétrault represents Canadian Association of Refugee Lawyers before the Supreme Court of Canada in Quebec (Attorney General) v. Kanyinda

On March 6, 2026, we represented the intervener, the Canadian Association of Refugee Lawyers ("CARL"), before the Supreme Court of Canada in Quebec (Attorney General) v. Kanyinda, 2026 SCC 7. The Court concluded that a Quebec law excluding asylum seekers from eligibility for subsidized childcare services constituted discrimination under the Charter. The Court adopted a rigorous approach to justification under s. 1 of the Charter, as advocated by CARL.
